A division bench of the Rajasthan High Court has taken a highly strict and sensitive step regarding the physical efficiency test rules for female candidates in the Rajasthan Forester Recruitment 2025 (Rajasthan Forester Recruitment 2025). The court has raised serious objections to the rule concerning chest measurement and expansion for female candidates. The division bench of Chief Justice Sanjay K. Agrawal and Justice Baljinder Singh Sandhu has issued notices to the state government and the Rajasthan Staff Selection Board (RSSB) seeking their response on the matter.
This judicial intervention is considered highly significant from the perspective of protecting the self-respect, privacy, and constitutional rights of female candidates. While women's participation in crucial sectors like the Forest Department is steadily increasing, such outdated and illogical rules pose a major obstacle in their path. Following this decision, hopes have risen for major reforms in the physical test criteria for women in government jobs.
This entire legal dispute came to light after a D.B. Civil Writ Petition was filed in the Rajasthan High Court by Jyoti Sharma. Representing the petitioner, senior advocates Amit Gaur and Bhawani Singh Tanwar raised serious legal and scientific questions before the court regarding the physical criteria related to chest measurements for women in the Forester recruitment. They argued that this rule is entirely based on a conservative mindset and should have no place in a modern administrative system.
Hearing this petition, the division bench of the High Court took a strict stance and questioned the state's administrative framework. In this regard, the court issued notices to the following key officials and departments, directing them to clarify their stance by the next hearing:
The court has asked all these responsible officials on what basis and under what scientific logic such physical tests have been made mandatory for women.
The primary legal root of this entire controversy is Rule 19(2)(a) of the "Rajasthan Forest Subordinate Service Rules, 2015". Under this rule, provisions for minimum chest measurement and required expansion have been laid down for both male and female candidates for recruitment to posts like Forester and Forest Guard. The petitioners argue that this provision is completely arbitrary, illogical, and unscientific.
From the perspective of biology and medical science as well, this chest measurement rule for women cannot in any way be a measure of their physical capability or eligibility to perform the duties of a Forester. The lung capacity and physical structure of women differ from those of men. In such a scenario, directly imposing criteria designed for men onto women not only reflects administrative short-sightedness but also deeply hurts the mental health and self-confidence of female candidates.
The petition places special emphasis on the fact that this chest measurement rule for female candidates directly violates the fundamental rights guaranteed to citizens by the Indian Constitution. The lawyers argued in court that this rule is primarily against the following articles:
"There can be no compromise on the privacy and dignity of women in the name of physical efficiency. Article 21 of the Constitution grants every citizen the right to live with dignity, which must be respected in every government recruitment process."
This is not the first time a controversy has erupted over the chest measurement rule for women in government recruitments in Rajasthan. Previously, a single bench of the Rajasthan High Court had termed such rules completely wrong, derogatory, and unconstitutional.
The single bench of the High Court had previously, in the case of Writ Petition No. 6847/23 (Vandana Kanwar & Ors. vs. State of Rajasthan, Judgment dated 10.08.2023), held such rules to be against the privacy and dignity of women. The court had explicitly stated that such criteria are not necessary for testing the physical efficiency of women.
Despite this clear and strict stance of the court, the Forest Department re-included this controversial provision in the Physical Efficiency Test (PET) of its current Rajasthan Forester Recruitment 2025. Taking cognizance of this stubbornness of the department and disregard for court orders, the division bench of the High Court has now taken an extremely strict stance.
The statistics regarding the total vacancies under the Rajasthan Forester Recruitment 2025 and the candidates called for the ongoing Physical Efficiency Test (PET) can be clearly understood through the following table:
| Details | Numbers |
|---|---|
| Total Advertised Forester Posts | 785 posts |
| Total Candidates Called for Physical Efficiency Test (PET) After Written Exam | 1413 candidates |
| Total Posts in Bikaner Division | 259 posts |
| Posts Reserved for Women in Bikaner Division | 80 posts |
| Total Shortlisted Candidates in Bikaner Division | 159 candidates |
| Shortlisted Female Candidates in Bikaner Division | 66 candidates |
It is clear from the above statistics that a large number of female candidates are part of this recruitment process. In the Bikaner division alone, out of 159 shortlisted candidates, 66 are female candidates. This number constitutes more than 41% of the total shortlisted candidates, which shows how eager and capable women are to join forest protection and administrative services. In such a scenario, protecting their self-respect should be the primary duty of the government.
Following these notices issued by the High Court, the state government and the Rajasthan Staff Selection Board (RSSB) will now have to present their explanation before the court. This judicial intervention could have the following profound impacts on the recruitment process and future rules:
This step taken by the division bench of the Rajasthan High Court could prove to be a milestone in the direction of women's empowerment and gender equality. To increase women's participation in government jobs, it is extremely important to create a favorable, safe, and respectful environment. Modern and scientific methods should be used to test physical efficiency, rather than outdated rules that hurt personal dignity. It is hoped that the final decision of the court in this matter will fully protect the honor, respect, and constitutional rights of female candidates.
