Once again, big news has emerged for thousands of teacher candidates in Rajasthan. The stay on the appointment process of the Grade 3 Teacher Recruitment Level-1, conducted by the Rajasthan Staff Selection Board (RSMSSB), will continue. Recently, a highly crucial hearing regarding this recruitment took place in the Rajasthan High Court, which has slightly prolonged the wait for the candidates. The court flatly refused to lift the interim stay on the recruitment and has scheduled the next hearing of the case for October 12, 2026.
Following this court decision, anxiety has increased among those candidates who have been waiting for their appointments for a long time. On the other hand, hope for justice remains alive for the candidates who were excluded due to disputed questions. In this article, let us explore in detail what happened in court, what the arguments of both sides were, and what the future of this recruitment might look like in the coming times.
This dispute is not new. Ever since the results of the Grade 3 Teacher Recruitment Level-1 were released, there has been massive dissatisfaction among candidates regarding disputed questions and answers. Many candidates believed that the answers to some questions asked in the exam were incorrectly marked by the board, while some important questions were deleted without any solid basis.
Due to the deleted questions and discrepancies in the Answer Key, the entire arithmetic of the exam changed, resulting in a large number of qualified candidates being excluded from the selection list. Regarding this discrepancy, Anita and other petitioners approached the Rajasthan High Court. The petitioners argued that until a correct and logical resolution to the disputed questions is reached, it would be unfair to make final appointments under this recruitment. Hearing this petition, the court had previously placed an interim stay on the appointments, which will now continue until the next hearing.
During this important hearing held in October 2026, a sharp debate was witnessed between both sides in the courtroom. Representing the petitioners, senior advocate Anand Sharma and advocate Arvind Kumar Sharma strongly presented the case of the aggrieved candidates before the court. They argued that if appointments are made at this stage, it would violate the rights of those candidates who might become genuinely eligible for selection after a correct evaluation of the disputed questions.
On the other hand, the counsel for the Rajasthan Staff Selection Board urged the court to lift this stay immediately. The board's counsel argued that the recruitment process has been stalled for a long time, and lifting the stay would allow the selected candidates to get their appointments soon. However, the High Court did not accept this demand of the board and flatly refused to lift the stay.
The single bench of the High Court agreed with the arguments of the petitioners' counsels. The court believes that if appointments are made at this juncture, 'third-party rights' will be created in favor of the selected candidates. In such a scenario, if any change or revision has to be made to the results in the future by court order, the entire recruitment process will become legally highly complicated.
Key Takeaway: Once candidates are given joining letters, removing someone from their job or issuing a new list if the results are revised later would create major legal complications for both the government and the board. Keeping this foresight in mind, the court has maintained the interim stay.
